By subscribing to or purchasing any video production service from Unthinkable Voices (“Company”), you (“Client”) agree to abide by these Terms of Service. These terms govern your use of our services and outline the conditions for payment, responsibilities, content ownership, and cancellation.
Service Description
Unthinkable Voices offers video creation services in three stages: Initial Discovery Call, Remote Interview, and Professional Video Production.
Delivery of Services
Unthinkable Voices delivers the following services per contract year (unless otherwise indicated):
Delivery timelines and specific production schedules will be determined in collaboration with the Client. Failure by the Client to engage in the production process, respond to communications, or provide necessary materials may result in delays, for which Unthinkable Voices shall not be held liable.
Client Responsibilities
The Client agrees to actively participate in the production process to facilitate the timely completion of videos, including but not limited to:
Contract Duration and Renewal
This Agreement commences on the subscription date and remains effective for twelve (12) months. It automatically renews for an additional twelve (12) months unless the Client provides written notice of termination at least sixty (60) days prior to the renewal date.
Payment Terms
The Client agrees to pay the applicable fees for the selected package. Subscription fees will be automatically processed monthly. The Client is responsible for maintaining accurate payment details.
Payment obligations are not contingent upon the completion of all videos if delays are attributable to the Client.
Non-Payment
Unthinkable Voices reserves the right to suspend services for non-payment. If payment is not received within sixty (60) days, the contract may be terminated, and the Client remains liable for any outstanding balances.
Cancellation & Refund Policy
The Client may cancel by providing written notice at least sixty (60) days before the contract term ends. If notice is not provided within this period, the contract will automatically be renewed for a subsequent twelve-month term. Upon cancellation, the Client will be responsible for any outstanding payments up to the effective date of cancellation.
Refunds are issued only for service delivery failures or compliance issues, with requests made in writing within thirty (30) days of service delivery.
Completion and Expiration of Videos
The Client shall have the right to initiate only one video project at a time under this Agreement. Each video must be completed before beginning the next video project.
Unthinkable Voices will make reasonable efforts to assist with scheduling and send reminders; however, it is the Client’s responsibility to remain responsive, adhere to scheduling timelines, and provide necessary materials and approvals.
If the Client fails to stay on schedule, delays content submissions, or is otherwise unresponsive, any unused video entitlements will expire at the end of the 12-month term. Expired entitlements are non-refundable and will not roll over into any subsequent contract periods. The Client remains responsible for all fees associated with the full contract term, regardless of the number of videos completed.
Pricing and Package Changes
Unthinkable Voices reserves the right to modify the pricing of subscription packages and other services. Any changes will be communicated to you with at least 30 days’ notice via the email address associated with your account.
The updated pricing will take effect on the next billing cycle following the notice period. If you do not wish to continue with the service at the new rate, you may cancel your subscription at any time before the new rates take effect, preventing any future charges.
You may also upgrade or downgrade your subscription package at any time. Any changes will take effect at the start of the next billing cycle, and your new payment amount will reflect the selected package.
Ownership and Rights
The Client retains ownership of all submitted content. Unthinkable Voices reserves the right to use the produced videos for promotional purposes unless otherwise agreed. The Client indemnifies Unthinkable Voices against any claims arising from the content provided.
Content Standards
Unthinkable Voices reserves the right to refuse to create content that is dangerous, illegal, defamatory, unethical, or otherwise inconsistent with our values. We also reserve the right to decline any project for any reason, at our sole discretion.
Modifications to Terms of Service
Unthinkable Voices may modify these Terms of Service at any time. Changes will be posted on our website, and continued use of our services constitutes acceptance of the revised terms.
Termination Clause
Unthinkable Voices may terminate the Agreement at any time if the Client violates any of the terms outlined herein. Upon termination, the Client shall remain liable for any outstanding payments.
Force Majeure
Neither party shall be liable for any failure to perform their obligations under this Agreement if such failure is due to a cause beyond their reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, or strikes.
Limitation of Liability
Unthinkable Voices’ liability for any claim arising out of this Agreement shall be limited to the amount paid by the Client for the services rendered. In no event shall Unthinkable Voices be liable for any indirect, incidental, or consequential damages.
Governing Law and Jurisdiction
This Agreement shall be governed by the laws of the state of Delaware. Any disputes arising out of this Agreement shall be settled in the courts of the state of Delaware.
Miscellaneous
This document constitutes the entire Agreement between the parties and supersedes all prior agreements or understandings, whether written or oral.
